Echo Tours Terms & Conditions and Code of Conduct
A CLUB'S TERMS & CONDITIONS WILL ALWAYS SUPERSEDE THAT WHICH IS LISTED BELOW. IF THE CLUB DOES NOT PROVIDE ADDITIONAL TERMS & CONDITIONS ALL CUSTOMERS WILL BE BOUND TO THE TERMS LISTED BELOW.
Payment Schedule: Unless otherwise defined by your Ski and Snowboard club, a $100 deposit per person must be paid in order to make a reservation. This must be submitted with a completed reservation form. Since reservations are on a first come first serve basis, no reservation will be taken unless both are submitted. We will make every effort to put you with your desired roommates. Please remember that your desired roommates do not have a reservation because their name is on your form. They must pay their deposit and sign a reservation as well.
You must pay the remaining balance of your tour cost NO LATER than 45 days prior to the date of your tour. In some cases your final payment is due even earlier. Your tour will be subject to immediate cancellation if you do not make your final payment on time. If you are signing up less than 45 days prior, you must pay the full amount in order to make a reservation.
Cancellation Policy: Unless otherwise defined by your Ski and Snowboard Club, a 50% refund of payments made for lodging, transportation and lift pass or ski rentals are refundable if cancellation happens 30 days prior to the date of your tour, unless your club/organization specifies otherwise. With in 30 days of a trip, there are no refunds but you may produce a substitute that was not previously signed up to fill your spot. Medical conditions do not change this cancellation policy. If you cancel your tour after rooming inventory has been assigned to the group, an empty pillow fee will be applied (empty pillow fee varies by resort). The motor coach transportation is subject to cancellation by ECHO TOURS if all seats are not filled. Canceling your tour at ANY TIME will result in a $25 cancellation fee.
All damage deposit funds are pooled within each property to cover any common area damage during a given week. Common area damage charges will be divided fairly and equitably between groups staying in the hotel or condominium development.
When you check in, you will be given a damage report to fill out. It is very important that you check your unit immediately for anything that could be considered damaged. Write down anything you find and return it to the front desk the same evening you check in. If you do not fill out a damage report and return it you will be responsible for anything wrong in your unit at the end of the week. If you leave your unit without cleaning it up when you check out, most properties will apply a clean up charge. Damage to individual units is the responsibility of individuals and will not be taken out of the common area damage deposit!!
Luggage: Please limit your luggage to one large suitcase, your ski equipment (if you are not obtaining rentals) and a small travel bag for one the motor coach. Make sure that you luggage is well identified. You are responsible for you luggage at all times. Echo Tours is not responsible if your luggage is left in a parking lot or taken by someone else. Please make sure it is always secure if you ever plan on leaving it. When you are waiting to leave on the last day, please make sure there are no valuables left unwatched, and that your luggage is locked.
Check-in: Check-in time during the ski season is 4 PM. If you arrive early the rooms may still not be ready until 4 PM. Please do not expect to get in before that time. When you check-in, you will be given keys for your use. If you lose keys, you will be charged. To get a key from the front desk, you must show your identification.
When you check in you will be given an itinerary with information on where to go for ski rentals, lessons and of course, a schedule of the week's parties and activities.
I authorize the use of my credit card as written on this form to cover any incidentals incurred while rooming with the ECHO TOURS program. Incidentals are, but in no terms limited to: smoking in non-smoking units, hot tub/pool damage, burns or stains to furniture or carpet, holes in walls, theft, property common area damage, excessive housekeeping expenses, and long distance telephone charges incurred during my stay. I understand that the amount of damages will be split equally among the credit cards of all members staying in the same unit/room/complex as I am. I also agree to the following rules regarding the units/rooms of the property complex.
1. For each non-returned key there will be a $15 charge placed equally on credit cards held for the unit/room.
2. No pets are allowed in any of the units.
3. No kegs are allowed in any of the units/room.
4. Check-out time for all units is 10:00AM. NO Late checkouts will be permitted. No change rooms will be assigned. If the unit is not vacated by 10:00 AM, a 50% room charge will be applied to your room's master bill.
5. The units should be left free of all debris; all garbage should be placed in appropriate trash containers. If the unit requires excessive housekeeping, all occupants of your unit will be individually charged $150 per hour of cleaning.
6. The hours between 10PM and 8AM are QUIET HOURS. Excessive noise will not be tolerated.
7. Occupants are subject to eviction & fines in the event of excessive noise. No refunds will be granted due to eviction and/or fines. Please be aware that every complex has local residents residing in them that will not tolerate misbehavior, we encourage them to call the local authorities if they deem necessary.
IMPORTANT!!!! BE SURE TO LOOK OVER YOUR UNIT FOR DAMAGE!!!
CONCERNS REGARDING ANY RECOGNIZED DAMAGE SHOULD BE REPORTED IMMEDIATELY TO THE PROPERTY MANAGEMENT COMPANY. SEE UNIT PHONE FOR DIRECTIONS & MANGMENT INFO.
I, the undersigned, Hereby waive all charge back rights to my card and agree to all tenants held within this Lodging Code of Conduct Form, and waive all right of refusal regarding damage assessment of the unit/room/complex for which I am assigned unless a walk through damage assessment has taken place. The walk through must be requested by 5PM, the day of arrival. If no walk through has taken place or recognized damage has been reported via walk through or in writing, the undersigned waives all rights regarding damage assessment from the unit/room/complex and all damages will be billed equally to all credit cards held for this unit/room/complex.
ACKNOWLEDGEMENT AND ASSUMPTION OF RISK
I acknowledge that by signing this document, I am releasing Freelivin' Entertainment (FE) and their respective agents, employees, members, sponsors, promoters, partners, officers, directors and affiliates (collectively "Releasee's") from liability. This release form is a contract with legal consequences. I have been advised to read it carefully before signing.
Freelivin' Entertainment activities covered by this document include: skiing, snowboarding, swimming, fishing, caving, canoeing, boating, other water activities and any other recreational activity and/or event offered by Freelivin' Entertainment.
I agree to read all posted signs and warnings including instructions on use of ski lifts, boats and equipment and I agree to obey those signs and warnings located at the Resort or Lodging or at any facility or premise of the Resort and Lodging and to obey instructions from Resorts staff. I understand that I will be using ski lifts, riding in boats and swimming with out an instructor and if an FE staff member accompanies me that they are acting
as an individual and not as a representative of FE. I understand that FE is not responsible for the malfunction or damage of any equipment by a 3rd party rental company. This includes skis, snowboards, boots, bindings, boats and other water based equipment.
I acknowledge that the activities of this trip have risks, including certain risks that cannot be eliminated without destroying the unique character of the activities. The same elements that contribute to the unique character of these activities can cause loss or damage to my rental equipment, accidental injury, illness, or in extreme cases, permanent trauma, disability or death. I understand that FE does not want to frighten me or reduce my enthusiasm, but considers it is important for me to know in advance what to expect and to be informed of the activities' inherent risks.
The following describes some, but not all, of those risks:
• Travel is by vehicle, skis, foot, boat, canoe and other means, terrain, including lakes, snow and ice, canyons, and slippery rocks. Attendant risks include falling, drowning and others usually associated with such travel, including environmental risks.
• FE activities are conducted indoors and outdoors, day and night. Physical activities include snowboarding, skiing, hiking, swimming and diving.
• FE event participants who are under the age of 21 and who partake in the act of drinking alcoholic beverages do so at the sole risk of the participant. FE has no responsibility for such activities and will not provide alcohol to those participants under age.
• The FE staff is on site to provide transportation on land and water. An FE staff member may join participants in any of the mentioned activities or events but they are acting as private individuals, and not for FE.
I am aware that activities while participating on a trip provided by FE include risks of my injury or death. I understand the description above of these risks is not complete and that other unknown or unanticipated risks may result in property loss, injury or death. I agree to assume responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate, and I elect to participate in spite of and in full knowledge of the inherent risks. I acknowledge that attending an FE trip may require a degree of skill and knowledge different from other activities and that I have responsibilities as a participant. I acknowledge that the staff and volunteers of FE act as guides for the trip. I represent that I am fully capable of participating on the trip, without causing harm to others or myself. Therefore I, and my parent(s) or guardian if I am a minor, assume and accept full responsibility for me and for injury, death and loss of personal property and expenses suffered by me and them as a result of those inherent risks and dangers identified herein, those inherent risks and dangers not specifically identified, and as a result of my negligence or otherwise wrongful conduct in participating in these activities.
For myself, my heirs, executors, administrators, legal representatives, assignees, and successors in interest (collectively "Successors") I HEREBY WAIVE, RELEASE, DISCHARGE, HOLD HARMLESS, AND PROMISE TO INDEMNIFY AND NOT TO SUE the Releasee's and the sponsors of this event, the organizer, property owners, law enforcement agencies, all public entities, special districts and properties, and their respective agents, officials, and employees through or by which the events will be held, (the foregoing are also collectively deemed to be Releasee's), FROM ANY and all rights and CLAIMS INCLUDING CLAIMS ARISING FROM THE RELEASEES' OWN NEGLIGENCE, which I have or which may hereafter accrue to me and from any and all damages which may be sustained by me directly or indirectly in connection with, or arising out of, my participation in or association with the event, or travel to or return from the event. I agree it is my sole responsibility to be familiar with the Releasee's rules, and any special regulations for the event. I understand and agree that situations may arise during the event and may be beyond the immediate control of FE. I will follow the instruction and guidance of the trip leader(s). I have no physical or medical condition, to my knowledge, that would endanger others or me if I participate in this event, or would interfere with my ability to participate in this event.
In addition, I hereby grant full permission to the trip leaders, Freelivin' Entertainment and their respective agents, boards, commissions, and any other involved parties of the foregoing to use photographs, videotapes, motion pictures, or any other record of this event, including my name, likeness and/or voice for any legitimate purpose, including for advertising display, audiovisualpresentations or otherwise.
I agree, for myself and my successors, that the above representations are contractually binding, and are not mere recitals, and that should I or my successors assert my claim in contravention of this agreement, the asserting party shall be liable for the expenses (including legal fees) incurred by the other party or parties in defending, unless the other party or parties are finally adjudged liable on such claim for willful and wanton negligence. This agreement may not be modified orally, and a waiver of any provision shall not be construed as a modification of any other provision herein or as consent to any other provision herein or as consent to any subsequent waiver or modification. Every term and provision of this agreement is intended to be severable. If any one or more of them is found to be unenforceable or invalid, that shall not affect the other terms and provisions, which shall remain binding and enforceable. This agreement is entered in to voluntarily, after careful consideration and is binding upon the persons signing below, their heirs, executors, administrators, wards, minor children and other family members.

What personal information we collect:
When you create an account on the Echo Tours website you provide us with your name, email, address, phone number, gender, graduation date, height/shoe size for rental purposes and birth date. You will also be able to add a picture of yourself.
The purpose of using the Echo Tours site is to register for a services provided by the company. Specific details about your trip are recorded and collected
A benefit of using the website is to connect with other trip participants within your group so you may ask questions and exchange information like pictures and videos. Examples include updating your trip status by making a payment, submitting a Q&A, uploading a photo or video, and making comments in the Media Center.
Transactional information obtained during the payment process is retained by a third party payment gateway and follows it's own privacy policies. Please see Authorize or PayPal for more information.
Information we collect when you interact with the Echo Tours registration portal:
Site activity information. We keep track of some of the actions you make while in the portal, such as creating a photo album, sending messages, using the Q&A Center, indicating you "like" a post, and attending an event/trip. In some cases you are also taking an action when you provide information or content to us. For example, if you share a picture or video we might log the fact that you shared it.
Access Device and Browser Information. When you access the Echo Tours registration portal from a computer we may collect information from that device about your browser type, location, and IP address, as well as the pages you visit.
Cookie Information. We use "cookies" (small pieces of data we store for an extended period of time on your computer, mobile phone, or other device) to make the portal easier to use and to protect both you and Echo Tours. For example, we use them to store your login ID (but never your password) to make it easier for you to login whenever you come back to the portal. We also use them to confirm that you are logged into the portal. Removing or blocking cookies using the settings in your browser, will impact the portal's functionality and your ability to use it.
What we do with your information:
We use the information we collect to provide our services and features to you, to measure and improve those services and features, and to provide you with customer support.
We may contact you with service-related announcements from time to time. You may opt out of all communications except essential updates on your account. We may include content you see on Echo Tours in the emails we send you.
We don't share your information with advertisers without your consent.
Certain downloadable software applications, such as our SMS system and photo folders, transmit data to us. We may not make a formal disclosure if we believe our collections of and use the information is the obvious purpose of the application. We will make disclosures where we believe it is not obvious so that you can decide whether you want to use the feature.
Information we receive from Third Parties:
We do not own or operate the secured payment gateways or insurance policy providers that you use through the registration portal. Whenever you connect with a payment gateway or purchase optional travel insurance, we will receive information from them, including information about actions you take. In some cases, in order to personalize the process of connecting, we may receive a limited amount of information even before you connect with the application or website.
Information you share with Third Parties:
We do not own or operate the Third Party applications like Picasa, Google Voice, Authorize.net and PayPal gateway.
Exporting Information. You may use tools like RSS feeds, mobile phone SMS notification, or the Picasa photo library that means that when you use those applications and websites you are making your Echo Tours information available to someone other than Echo Tours. Prior to allowing them to access any information about you, we limit their use of your information and use technical measures to ensure that they only obtain authorized information.
Protection of Personal Information:
Echo Tours takes precautions — including administrative, technical, and physical measures — to safeguard your personal information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction.
Echo Tours uses Secure Socket Layer (SSL) encryption on all web pages where personal information is collected. To make payments using the Echo Tours portal you must use an SSL-enabled browser such as Safari, Firefox or Internet Explorer. Doing so protects the confidentiality of your personal information while it's transmitted over the Internet.
When registering for a Echo Tours trip limited personal information is shared with members of your group. Postings made in the Q&A Center are all public to members within your group. If you do not want to be seen or contacted by others please make the necessary changes to your profile under the Privacy tab or contact us at security@EchoTours.com.
We do not knowingly collect personal information from children under 13. If we discover a person under the age of 13 has created a profile and registered for a trip we will take the necessary steps to delete the account immediately.
